There is a lot in the press about this, but it is aimed at teenagers/schoolies etc that are doing it which is officially child porn if under 18...not sure if it applies to consenting adults???

I live in a lovely bubble of ignorance, not watching the news or anything like that, but I thought it was just in regard to pics of underage people. i.e. teens with mobile phones, etc.

I know by reference to reliabLe authority that would be the case if the person photographed was a minor. You would also run fowl of the law if you send pics of yourself to a minor. Otherwise I think sexting is currently legal here in Aus... but don't get in a plane bound for some other country with those pics on your phone. Hugs Staky

This is ridiculous - totally. Soon there will be a license for oxygen consumption. On a separate note - the quality of photos from phones is very poor and a digital camera is much better.

Then it becomes an issue. They cannot ban naked pics on our phones unless they manage to ban all porn. *snort* like thats gonna happen any time soon. No it is designed to protect the kids. Teens more than anything. Some sweet young things find it a game to send lewd pics of themselves.

People on the internet including RHP want pictures . If you have never met them then how would you know they are not a minor? The pictures they send you may not even be them at all. My thoughts are do not send them to anyone, at all. I have in the past but just feel its better to keep your pants on till your in a room with a person then they can see your bits for themselves. Even if you do meet them,make sure they are over 18 there are some pretty young looking guys on here and they could easy be under 18. Same for girls. Ignorance is no excuse when it comes to the law. So guys if you want to text the pink bits be careful it can be an offence. The phone can be used against you in a court of law so can y our activities on the computer, face book and RHP can be used in child custody cases or other legal procedures. I know a private investigator and she gets it all off the internet Even here one of the guys managed to find me, without knowing my name. got an email with my full name, and my phone numbers and a picture of my house. all I gave him was my hotmail address. be afraid :) of what you do in cyber land or the phone. It can come right to your door. Lucky for me he was not a stalker.

Thankfully you are not quite right. It is not illegal for two consenting adults of mandatory age to send each other photos of whatever they choose to. It would only be illegal if the recipient is under the age of consent or the photos depict someone under the age of consent or an illegal act. How do I know? I've worked in telecommunications for 15+ years and know the telecommunications act in detail (fun reading - not!). Email is considered electronic communication as is SMS or MMS, so emailing someone a photo would also be breaking the law which thankfully it isn't. ;-)

It is totally illegal if; a. the pictures are of an underage person b. The recipient is an underage person c. The pictures are of a person who has not given permission for the transmission d. The pictures are sent to a person who objects to receiving the pictures. It used to be illegal to swear over the phone or send offensive texts as well but again it depends on the person in receipt of the call or texts. I cannot find any legislation that deals with the matter between consenting adults. if anyone has a legislative link please post it but in the CRiminal Code (Cth) it is only illegal as i stated above. RHP does not have the capacity to tell who is underage at all there are plenty of fake profiles and kiddies do get hold of parents cards. A crime is defined by the law, and the outcome is determined in court when working in the jails I met a guy who got 18 months for a text threat to his wife. many get convictions from images on their computers, so a phone is no different. I am sure you can be a minor on this site, though RHP would soon get rid of them if the truth were known. We have to remember that a lot of profiles re fake , ie its a man pretending to be a woman yada yada I have adds in the paper for my photographic service and I do not respond to text messages with any detail at all I make them call me for an apt. So I know its an adult and I say we can discuss this face to face regarding what you want for your photographs. I do not trust the phone at all unless its someone I have met face to face. and hugs back at ya :)

The first step in dealing with those who would interfere with your rights or property is to deny consent - loudly and longly. Let there be no doubt that every time they speak to you, ask any question or attempt to touch you that they are violating your rights. If you're forced to do something then inform your aggressor (and their superiors when the opportunity presents) that you are under duress.

Stalky that is a bloody good point! The last strict country I was in was Vietnam... the government shut down facebook for a week because is didn't like what some students were writing.... very conservative country on the whole. From now on I will definitely delete all pictures prior to travelling. xxMeeks

Aside from the legality and morality of it... most providers and sites take this very seriously and are all too happy to help with investigations. Those who do break the law are taking their chances. As guy who plays with databases most of his day, when authorities are given access to the back end... they can usually narrow down searches with only basic information.

they are allowed to check phones and computers etc at Australian airports...since last year....to stop some pornography from reaching our shores...specifically the stuff that ends in criminal prosecutions.....

minors and RHP? just how do they guarantee that a minor cant have a profile?....heres a tip... they cant. a teen could even set up a premium fully paid for membership, using someone elses credit card...same way kids buy gear from ebay......etc. i know of 'trusted' kids who have dads business visa details, and are able to purchase whatever they like up to a preset dollar value, no questions asked. mine charge various membeships to the home phone...we dont question this, as its never gotten out of hand........

Really Mike? I didn't know that about Australian airport security!! Lucky I look so innocent that they wouldn't think of asking me. Jesus... reminds me of when I got grilled going out of Israel... obviously too many middle eastern country stamps in my passport. I got hauled off the line and they wanted to look through my travel diary, asking about my family, etc. They separated my friend and I to see if we would answer the same! The providers (Telstra, Optus etc) can only place an interception or monitoring on your phone at the request of ASIO, state or federal police. Even then the providers do not get to see or listen to the intercepted content, only the authority who has obtained a warrant (based on reasonable doubt or evidence that something illegal is happening) get provided with the content. If you are unsure as to whether the pics you are sending might be questionable, happy for you to send some of them to me for review (and rating out of 10) haha

What if someone else goes through you phone or picks it up? Its happened to me when I was driving I said to my friend will you get that for me,as I was expecting call from my daughter. Yep a guy wanking a nice little movie for me. Now I guard my phone with my life, though you cant help grown kids who just pick up your phone when your outside and say mahhhhh this big willy must be fore you! It comes with the job sometimes , I do get some odd calls as taking erotic pictures is my job. I really do not need to see a willy on my phone. I see plenty at work. Neither does any one else that picks up my phone. Not everyone has boundaries when it comes to snooping in others phones, especially married people. So may people get caught out by their mobiles.
